The background to the application is that the applicant was employed by the respondent as a Delicatessen Assistant. She was dismissed from employment on allegations of theft. She is alleged to have stolen a bottle of mayonnaise and hid it in her underpants on 3 November 2009.

During the period extending from 14 to 18 October 2013, the two respondents who were employed by the appellant joined other employees in a collective job action. The strike was over unpaid salaries. An attempt by the appellant’s management to stop the strike failed leading to the issuance of a disposal order by the Labour Court on 30 October 2013 declaring the job action illegal and directing the workers, who included the respondents, to return to work.
