1. This is an appeal against the conviction and sentence of the appellant by the High Court on a charge of murder.
2. The appellant was charged with murder as defined in s 47(1) of the Criminal Law (Codification and Reform) Act, [Chapter9:23]. The allegation was that on 23 October 2011 at house number 221 Ephraim Blank Street, Chivhu, he unlawfully caused the death of Modester Chikaka by pouring paraffin over her body and setting her on fire causing severe burns all over her body, from which injuries she died on 26 October 2011. On 14 December 2012 the Labour Court delivered a judgment in respect to this matter. Condonation for the late noting of appeal and extension of time was granted by this Court on 20 September 2017. The appellant and respondent were married on 29 September 2012 in terms of the Marriages Act [Chapter5:11]. Their union was blessed with a minor child, Makatendeka Mubaiwa, born on 5 July 2013.
