On 25 November 2021 I dismissed the applicants’ application for bail pending trial based on changed circumstances. I gave my reasons for that decision in court.
On 10 December 2021 applicants wrote to the Deputy Registrar requesting reasons for judgment unfortunately the applicants legal practitioners cited a wrong case number. The Respondent (plaintiff in court a quo) purchased 45 bags of 50kg PC 15 cement from N. Richards Rusape sometime in October 2017. The appellant who was employed at N. Richards agreed to look after the cement which the respondent was to collect later. The Respondent sent in One Nyakurima to collect some of the cement leaving a balance of 33 bags. On Christmas day, 25 December 2018, the accused in the company of the deceased left Bethania Business Centre after some beer drinking.
