On 13 July 2018 parties signed an order by consent before MWAYERA J (as she then was) and resolved a dispute between the applicants and respondent pertaining to change of ownership of Toyota Ipsum Registration number ABO 4985 into the names of the applicants. This is an appeal against both conviction and sentence where the appellant was convicted of Robbery as defined in S 126 (1) of the Criminal Law (Codification and Reform) Act, [Chapter 9:23] where he was sentenced to 48 months imprisonment of which 6 months imprisonment was suspended on the usual conditions of future good behaviour. The appellant was charged and convicted of fraud as defined in s 136 of the Criminal Law (Codification and Reform) Act [Chapter 9:23] and was sentenced to 20 months imprisonment of which 4 months imprisonment was suspended for 5 years on condition accused does not during that period commit any offence involving dishonesty of which he is sentenced to imprisonment without the option of a fine.
