This is an application for stay of execution of an arbitral award handed down by Honourable N.K. Nhimba on 14 August 2013. The award nullified the short time work implemented by the applicant from 1 September 2011 to May 2013. This is an application for condonation of late noting of appeal. Applicant was employed as a Dump Truck Operator by respondent. He was dismissed from employment on 24 March 2014 after having been found guilty of stealing diesel and selling it to a third party. On 26 March 2014 he appealed to the Disciplinary and Grievance Committee. This is an application for leave to appeal against a decision of this court issued on 10 October 2014. The respondent was employed by the applicant as a site quantity surveyor on 17 February 2012. It is alleged that he stopped going to work in March 2013 only to report for work in June 2013 demanding his salary.
