This matter was placed before me by the Registrar on automatic review. The accused, a 29 year old single mother of 3 minor children appeared before a Magistrate at Western Commonage facing a charge of contravening section 7(1) of the Children’s Act (Chapter 5:06) “Ill treatment or neglect of children and young person”. She pleaded guilty and was sentence to 36 months imprisonment of which 6 months imprisonment was suspended for five years on condition that accused does not within that period commit any offence involving ill treatment or neglect of a child and for upon conviction will be sentenced... Laye Fode Kaba (the deceased) was a Guinea National who was residing in Mozambique but would frequent Zimbabwe to illegally deal in diamonds from Chiadzwa area. He was known to both accused and it is clear from the evidence led and accepted by the court that the deceased was very close to the accused persons whom he relied upon as his agents in the lucrative illegal diamond business. He pleaded guilty to two counts of having sexual intercourse with his 15 year old girlfriend in contravention of s 70(1)(a) of the Criminal Law (Codification and Reform) Act [Cap 9:23]. The accused was charged with murder of his grandmother, Vhareta Deza, who died on the 19th of September 2016. The fatal assault is said to have been committed by the accused when he was a juvenile.
