The accused persons were convicted by a Regional Magistrate for contravening ss 131 and 113 of the Criminal Law (Codification and Reform) Act [Cap 9.23] herein-after called the Code. They unlawfully entered the complainant’s premises and stole property from his house and a motor vehicle from his premises. They pleaded guilty to the charges, and were convicted. They were each sentenced to 15 years imprisonment, of which 6 years was suspended on conditions of good behaviour. Both counts were treated as one for sentence. More

The first and second accused pleaded not guilty to a charge of murder as defined in s 47 of the Criminal Law (Codification and Reform) Act [Cap 9:23]. The state, alleged, that they, murdered the deceased on 18 November 2008. The deceased was their paternal grandfather. They were staying with him in Mhondoro. The question raised in the present review is whether an acquittal after a full criminal trial is subject to review at the instance of the complainant. The record of proceedings was forwarded by the Provincial Magistrate Harare at the request of a firm of legal practitioners, which was instructed by the complainant who was dissatisfied with the acquittal of the accused person after a full trial. The six accused persons are charged with treason as defined in s 20 of the Criminal Law (Codification and Reform Act [Cap 9:23], alternatively contravening s 30 of the Criminal Law (Codification and Reform Act [Cap 9:23] that is to say, causing disaffection among the Police Force or Defence Force. The accused person was convicted on three counts of contravening s 65 of the Criminal Law (Codification and Reform) Act Cap9:23. He was sentenced to five years imprisonment of which three years were suspended on conditions of good behaviour and the remaining two years were suspended on condition he performed 840 hours of community service. The accused was 16 years old at the time he committed the offences. He was 19 at the time he was convicted and sentenced. The complaint was 12 years old at the time she was raped. More
