MAKONESE J: The accused has been arraigned in this court on a charge of murder. It is alleged that on 1st January 2018 and at 2338 Emakhandeni, Bulawayo, he assaulted Bhekimpilo Moyo intending to cause his death or realizing that there was a real possibility that death might ensue. On the 4th of July 2018, the deceased, a taxi driver reported for work at Proline Taxis, Bulawayo. He took out his motor vehicle, registration number ACL 8064 and went about his duties. He worked the whole day late into the night. That same evening he was hired by an unknown person and drove with his passenger along the Bulawayo-Matopo Road. The accused is facing a charge of murder as defined in section 47 (1) (a) of the Criminal Law (Codification and Reform) Act, Chapter 9:23. It was the state case that the accused was 33 years old whilst the deceased was 30 years old at the time of his death. On the 27th May 2017 and in the early evening hours the two accused persons acting in common purpose proceeded to Jalukange business centre, Tuli, in Beitbridge. The first accused was carrying an AK 56 rifle concealed in a rolled reed mat tied on both ends with a red and white cloth. Accused persons entered a shop at the business centre. The 2 accused persons face a charge of murder, it being alleged that on the 30th of May 2011, and at Mopani Business Centre, Gwanda, the 2 accused persons struck Osbourn Mushana once on the head with a log intending to kill Osboourn Mushana.
