This is an application for leave to appeal against the judgment of the magistrate courts wherein the Regional Magistrate J Mabeza Esquire sitting at Gwanda Regional Court acquitted three respondents on certain charges which I will set out in detail later. Under case number HC 3895/15 the judgment creditors obtained judgment against Tritravel Services (Pvt) Ltd and Editha (Pvt) Ltd, the first and second judgment debtors respectively, in the sum of US$89 500.00. A warrant of execution was issued instructing the Sheriff to attach and take into execution the judgment debtor’s immovable property described as Lot 1 of Subdivision G of Subdivision D of Ntaba of Glen Lorne Township, Harare. This is an interpleader application whereby the claimants claim ownership of property attached in execution by the applicant at the instance of the judgment creditor. More

The applicant is the Sheriff for Zimbabwe. He brings this application in terms of Order 30 r 205A as read with r 207 of the High Court rules 1971. In terms thereof, the Sheriff who has attached property in execution of a writ issued by this court may approach the court for a determination of adverse claims where a claim(s) is made to the attached property by a party who is not the judgment debtor.
