This is an appeal against the decision of the designated agent for NEC Engineering. Two issues were for contest before the Designated Agent i.e. the issue of arrear salaries and benefits on one hand and the issue of leave days on the other hand. At the onset of the appeal the appellant abandoned the first ground relating to salary arrears thus leaving only the issue of leave days. More

The applicant and his co-accused who is not part of this application were indicted before this court on a charge of murder as defined in section 47 of the Criminal Law (Codification and Reform) act [Chapter 9:23]. It being alleged that on 16 January 2021 they struck the now deceased on the head with a metal bar intending to kill him or realizing that there was a real risk or possibility that their conduct may cause his death continued to engage in that conduct despite the risk or possibility. At the close of Plaintiff’s case, Defendant launched an application for absolution from the instance. As was to be expected, the application is opposed by Plaintiff. Plaintiff issued a summons in his individual capacity in 2016 out of this Court claiming payment, form the Defendant of US$234 500.00 plus costs of suit on a legal practitioner and client scale. On the 25th August 2022 at Harare, applicant in her capacity as a Labour Officer issued a ruling. She ordered 2nd respondent (employer) to pay 1st Respondent (employee) a sum of US$507 917 and other items. Apparently the employer did not comply. Applicant then applied to this Court for the confirmation of her ruling in terms of section 93(5a) of the Labour Act Chapter 28:01. The employee supported the application whilst the employer opposed it. More

On 29 January 2016 the applicant signed a loan agreement with the 1st respondent to the tune of USD600,000.00 repayable in 36 months on agreed interest rates. The money was deposited into 2nd respondent’s account with CABS. The 3rd respondent signed as a surety and co-principal debtor. On 27 July 2016 the applicant extended another loan facility to the 1st respondent to the tune of USD300 000.00 payable in 6 months. The loans were paid through transfer at the same bank from the applicant’ s non-resident account. More
