The state alleges that on 23 August 2024 at around 0100 hours the two accused and two others who are at large, together with the now deceased caught a monkey which they intended to sell to other gold panners who consume monkey meat. They failed to find a buyer. The now deceased suggested that they give the monkey away. This annoyed the 2 accused and the others still at large. The accused is facing a charge of murder as defined in s 47(1) of the Criminal Law (Codification and Reform) Act [Chapter 9:23]. She pleaded not guilty to the charge. The state alleges that the accused and her husband, one Baron Chigudu who had a special verdict returned in the same matter, hatched a plan to kill the now deceased in order to steal his property and raise money to buy a taxi. They were employed by the now deceased as domestic workers. On 28 December 2022 the now deceased went to the farm to attend to his cattle. More

The three accused are charged with murder as defined in s 47(1) of the Criminal Law (Codification and Reform) Act, [Chapter 9:23]. Accused 1 tendered a limited plea of guilty to culpable homicide which was rejected by the state. Accused 2 and 3 tendered pleas of not guilty. : Abel Hungwe (the offender) was arraigned before the court of a magistrate at Mvuma on charge of theft as defined in section 113(1)(a)(b) of the Criminal Law (Codification and Reform) Act [Chapter 9:23] (“the CODE”). He had, on the 12 November 2024, stolen various items which belonged to Gloria Karavhina. He pleaded guilty to that charge and was duly convicted. My view is that the conviction was proper. The accused a 41-year-old woman gave birth to a male child on the 23rd of November 2024. On delivery she left the child unwrapped with the result that the child died from exposure to the weather conditions. When the child died accused threw the dead body into a Blair toilet pit. The child’s dead body was retrieved from the Blair toilet after some days and the post-mortem indicated that the cause of death was indeterminate. The accused person has been convicted of murder with constructive intent of the deceased Viola Chitsinde, a woman with whom he had two minor children and used to stay with as his second ‘wife’, through assaults and strangulation using an electric iron power cable. The offence took place on the 28th of October 2024, at Tegwede Shop, Masiyarwa Business Centre, Zvimba.
